The Governor has announced an in person special session for 8am, Monday December 21st. The session will be limited to a few legislative concepts and including funding allocation for the emergency board. It is my hope that this session will provide an opportunity for legislators to come together and support all Oregonians as we continue to navigate 2020. Proposed legislation prioritizes families and kids, restores jobs and takes our first steps to prevent frivolous lawsuits, while setting aside resources to balance our budget, fund wildfire recovery and support public health.
A few of the legislative concepts being brought forth are as follows:
LC 10
Allows holder of full on-premises sales license to sell mixed drinks in sealed containers for off-premises consumption.
Requires third-party food platform to enter into agreement with restaurant before facilitating orders and deliveries from restaurant. Limits service fees that third-party food platform may charge restaurant. Imposes civil penalty not to exceed $500 per violation. Defines “third-party food platform.”
Sunsets on date on which declaration of state of emergency issued by Governor on March 8, 2020, and any extension of declaration, is no longer in effect.
Declares emergency, effective on passage.
LC 18
Requires Housing and Community Services Department to provide grants to certain residential landlords for unpaid rent after April 1, 2020. Appropriates moneys to department for this purpose. Requires department to re- port to Legislative Assembly on grants by September 15, 2021. Sunsets January 2, 2024.
Extends until December 31, 2020, emergency period during which residential evictions for nonpayment are prohibited. Extends until June 30, 2021, prohibitions of terminations without cause, emergency period and repayment date for nonpayment by tenants declaring financial hardships.
Extends 72- and 144-hour notices for nonpayment of rent to 15- and 18-day notices until June 30, 2021.
Tolls statute of limitations for residential landlords’ claims for nonpayment through June 30, 2021.
Declares emergency, effective on passage.
LC 21
Limits liability of school districts, union high schools, education service districts, public charter schools and community colleges for certain claims arising during COVID-19 emergency period.
Declares emergency, effective on passage.
